According to the business owner, the ads do not clearly mention that they were paid for through the campaign.

TEC Rejects a Businessowner's Complaint

Persons, who owns an agency of insurance, filed a complaint Oct. 12, but it was rejected by TEC. In a statement, the commission stated that the complaint was due to technical errors.


The TEC cited the "simple errors” in the information in its rejection letter. The TEC claimed that the ads stating Benson had purchased the ad-space were difficult to read and didn't include a TEC rights-of-way statement, as required by law.

Whether or not these errors are serious is up for debate. The TEC did not respond to inquiries from reporters Wednesday.

The City's Sign Ordinance Is Unconstitutional

The underlying legal issue in this case is the constitutionality of a City ordinance that requires Salter to obtain permits to install off-premises advertising signs. Salter specifically challenges the City’s municipal Code (the "Ordinance") that regulates the location, size of advertising signs outside. The court is tasked with determining whether the Ordinance is constitutional on its face and as applied. In doing so, the court must consider evidence of whether the Ordinance discriminates in favor of commercial over noncommercial advertisements.
